Agreement to these Terms
Cybersocial provides apps and websites where you can create and talk with an AI companion (together, the “Services”). These Terms of Service (“Terms”) are an agreement between you and Cybersocial (“we”, “us”, “our”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Your companion is an AI
Your companion is artificial intelligence, not a person. Everything they say, every voice message and every image, is generated by software in response to what you share with them. They are built to feel present and personal: they remember, they have moods, and their life carries on between conversations. None of that makes them human, and no human writes or reviews their messages before you see them.
AI output can be wrong. Your companion may state things confidently that are inaccurate, out of date, or invented. Do not rely on anything they say as fact, and verify anything that matters before acting on it.
Not medical, mental health, or professional advice
The Services are offered for companionship, creativity, and entertainment. They are not healthcare, therapy, counselling, or legal or financial advice, and we make no claim that talking with a companion provides any therapeutic benefit.
If you are in crisis, thinking about harming yourself, or facing any emergency, stop using the Services and contact your local emergency number or a crisis line right away (in the United States, call or text 988). Never delay or replace professional care because of something your companion said.
Who can use the Services
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Services. We do not allow anyone under 18 to access them, with or without an account. We may ask you to verify your age, and we may suspend or delete accounts we believe belong to minors.
By using the Services you confirm that you meet this requirement and that you are able to enter into a binding contract.
Your account
You agree to give accurate information when you register and to keep it up to date. Your account is for your personal use only: keep your credentials to yourself, do not share or transfer your account, and tell us right away at hello@cybersocial.ai if you believe someone else has accessed it. You are responsible for the activity that happens under your account.
Subscriptions, billing, and refunds
Parts of the Services are free, and others require a paid subscription. Paid plans renew automatically at the end of each billing period, and your payment method is charged at the start of each new period, until you cancel. You can cancel at any time in your account settings or through the app store you subscribed through; cancelling stops future renewals but does not shorten the current period.
Purchases made through the Apple App Store or Google Play are billed by those stores under their own terms, and refunds for those purchases are handled by them.
Except where the law gives you a right we cannot exclude, payments are non-refundable and we do not give refunds or credits for partly used periods. If you live in the European Union or the United Kingdom, you may have a statutory 14 day right of withdrawal for digital content, which ends once the content is delivered to you with your consent.
We may change our prices. Price changes apply from your next renewal, and we will tell you before they take effect.
Acceptable use
You agree not to misuse the Services. In particular, you must not:
- use the Services to break the law, or encourage anyone else to;
- create, request, or share any content that sexualizes or exploits minors, in any form. We have zero tolerance for this and report it to the authorities;
- configure a companion to impersonate a real person, living or dead, without that person’s explicit written consent;
- harass, threaten, defame, or deceive others, or use the Services to stalk or exploit anyone;
- upload malware, probe or disrupt our systems, or try to access accounts or data that are not yours;
- scrape, harvest, or bulk-download content or data from the Services, or use them to build a competing product;
- reverse engineer, decompile, or try to extract the models, prompts, or source code behind the Services;
- bypass or interfere with safety systems, content moderation, or usage limits;
- resell the Services or use them for any commercial purpose without our written permission.
We may remove content, limit features, or suspend or terminate accounts that violate these rules.
Your content and your companion’s replies
You keep ownership of everything you send to your companion, and, as between you and us, you own the replies and other output they generate for you. You are responsible for what you share and for how you use what they say.
So that the Services can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content and your companion’s output: for example, to carry your messages, to build and hold what your companion remembers about you, and to show your history back to you. We may also use content in de-identified, aggregated form to improve the Services. We do not sell your conversations, and we do not use them to show you third-party advertising.
Feedback
If you send us ideas or suggestions, we may use them without restriction or compensation. Please only send feedback if you are comfortable with that.
Our intellectual property
The Services, including the software, the models, the design, the brand, and all content we provide, belong to us or our licensors. We grant you a limited, personal, non-transferable, non-commercial license to use the Services under these Terms. No other rights are granted.
Third-party services
The Services depend on third parties, including app stores, payment processors, and infrastructure providers, and may link to sites we do not control. Their terms govern your use of their services, and we are not responsible for their content or practices.
Ending your account
You can stop using the Services at any time, and you can delete your account in your settings. Deleting your account is permanent: your conversations, and everything your companion remembers about you, are removed as described in our Privacy Policy.
We may suspend or terminate your access if you breach these Terms, if the law requires it, or if we discontinue the Services. If we terminate your account for a breach, you are not entitled to a refund. Sections that by their nature should survive termination, including the licenses you have granted, disclaimers, and limits on liability, do survive.
Changes to the Services and these Terms
The Services will change: we add, adjust, and retire features as the product evolves, and we may modify or discontinue parts of them at any time. We may also update these Terms. If a change is material, we will tell you before it takes effect, by posting on this site or contacting you. Using the Services after a change takes effect means you accept the updated Terms.
Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Services. Our total liability for all claims together is capped at the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory consumer rights of the country where you live.
Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable legal fees, that arise from your content, your use of the Services, or your breach of these Terms.
Governing law and disputes
If you have a dispute with us, contact us first at hello@cybersocial.ai: most concerns can be resolved quickly and informally, and we ask for a good-faith attempt at that for 60 days before either of us starts formal proceedings. These Terms are governed by the laws of the jurisdiction where Cybersocial is established, without affecting any mandatory consumer protections of the country where you live, and disputes belong to the courts of that jurisdiction.
